Property Division
Property in New York and New Jersey is awarded according to the laws of equitable distribution. This means that homes, personal property and assets may be split equally and fairly, but not necessarily 50-50. It is important to also note that debts are divided in this same way, as not to overburden one party with the marital debt.
Spousal Support
Also referred to as alimony, spousal support is not awarded in every divorce. However, when it is awarded, many factors are considered, such as the age of the parties, the contribution of the parties to the finances of the marriage, the length of the marriage and any other financial obligations, such as child support. We are able to review your case and defend your right to spousal support or attempt to protect you from having to make undue spousal support payments.
Child Custody and Child Support
We can take the time to explain how child custody may be awarded in your situation. The courts often award custody equally, as it is seen as being in the best interests of the child.
